Terms of Purchase
Introduction
These terms govern consumer purchases of goods over the internet. Norwegian consumer online purchases are primarily regulated by the Agreements Act, Consumer Purchases Act, Marketing Control Act, Right of Withdrawal Act, and the E-Commerce Act. These laws grant you non-waivable rights (see lovdata.no). Nothing in these terms limits your statutory rights; this document summarizes the key rights and obligations of both parties.
These terms are prepared and recommended by Forbrukertilsynet (the Norwegian Consumer Authority). For further guidance, see their official guide.
1. The Agreement
The agreement consists of these terms, information provided in the checkout flow, and any specially agreed conditions. If there is a conflict, the specifically agreed terms prevail unless contrary to mandatory law.
Relevant statutory provisions governing consumer purchases supplement this agreement.
2. The Parties

Buyer is the consumer placing the order and is hereinafter referred to as the “buyer”.
3. Price
The listed price for goods and services is the total price you pay, including all taxes and charges. You will not be responsible for any additional costs that were not disclosed before purchase.
4. Contract Formation
The agreement is binding for both parties when the buyer has submitted the order to the seller.
The agreement is not binding if there is a typographical or input error in the offer (or in the buyer’s order) and the other party realized or ought to have realized such an error.
5. Payment
Choose from three secure payment methods:
1) Card payment
We accept Visa, MasterCard, American Express, and Apple Pay via Stripe. Funds are initially reserved; once your order is packed and ready, the reserved amount is captured.
2) Klarna
For invoice payments, Klarna issues the invoice upon shipment. The due date appears on the invoice and is at least 14 days from receipt.
Buyers under 18 cannot pay by post-purchase invoice.

Delivery occurs when the buyer, or the buyer’s representative, takes possession of the goods.

Orders placed before 13:00 are packed the same day. Orders placed after are dispatched the next business day. Orders placed after Saturday 13:00 and/or on public holidays are shipped the next business day. Typical delivery time is 24–72 hours, depending on location and chosen method. We reserve against delays due to circumstances beyond our control.

Pick up in store at no extra cost. Your order is ready when you receive the receipt email for approved payment. Note: the order confirmation alone is not valid for collection. Orders placed after Friday 14:00 are normally processed on Mondays.
For pick-up, present your receipt email and valid ID. Collection by others is not possible unless specifically agreed in advance with the store.
Pick-up deadline: 14 days.
7. Risk of Goods
Risk passes to the buyer when the goods are delivered as described in section 6.
8. Right of Withdrawal (Angrerett)
Unless the purchase is exempt, you may withdraw from the contract under the Right of Withdrawal Act.
You must notify the seller within 14 days from the start of the withdrawal period. All calendar days count; if the deadline falls on a Saturday, public holiday, or bank holiday, it extends to the next business day.
The deadline is met if your notice is sent before it expires. You bear the burden of proof, so provide notice in writing (withdrawal form, email, or letter).
The withdrawal period starts:

For single deliveries: the day after you receive the item(s).

For multiple deliveries: the day after you receive the final delivery.
If the seller failed to inform you about the right of withdrawal and the standardized form before contract conclusion, the period extends by 12 months beyond the original deadline. If the information is provided within those 12 months, the period expires 14 days after you receive the information.
When using the right of withdrawal, return the goods to the seller without undue delay and no later than 14 days after notifying withdrawal.
Returns with our return label (shipping back to Vivid): a 90 NOK return fee applies. No fee for justified claims (defects).

If you choose to return the item yourself, we recommend a trackable shipping method. You are responsible for the item until it safely reaches us.

You may examine the item carefully to determine its nature, characteristics, and functioning without losing the right to withdraw. If handling exceeds what is necessary, you may be liable for any diminished value (e.g., scent or makeup traces on the product).
The seller must refund the purchase price without undue delay and no later than 14 days after being notified of your decision to withdraw. The seller may withhold the refund until the goods are received or you provide documentation that they have been returned.
9. Delay or Non-Delivery — Buyer’s Rights and Claim Deadlines
If the seller fails to deliver on time under the agreement, and this is not due to the buyer, the buyer may—under Chapter 5 of the Consumer Purchases Act—withhold payment, demand performance, terminate the contract, and/or claim damages.
For evidentiary purposes, such claims should be made in writing (e.g., email).
Performance
You may uphold the purchase and demand performance unless there is an insurmountable obstacle for the seller, or performance would cause disproportionate inconvenience or cost compared to your interest. If the obstacle ceases within a reasonable time, you may still demand performance. This right may be lost if you wait unreasonably long.
Termination
If the seller does not deliver by the delivery time, you must ask the seller to deliver within a reasonable additional period. If delivery still does not occur, you may terminate. You may terminate immediately if the seller refuses to deliver, if timely delivery was essential to the agreement, or if you informed the seller that the time of delivery was decisive. If delivery occurs after the additional period or decisive delivery date, you must exercise termination within a reasonable time after learning of the delivery.
Damages
You may claim compensation for loss caused by the delay, unless the seller proves the delay was due to an obstacle beyond their control that could not reasonably have been foreseen, avoided, or overcome.
10. Defects — Buyer’s Rights and Complaint Deadlines
If an item is defective, you must notify the seller within a reasonable time after discovering (or when you should have discovered) the defect. Notice within 2 months of discovery is always timely. You may complain no later than 2 years after delivery, or 5 years if the item is intended to last significantly longer.
Where there is a defect not caused by the buyer, the buyer may—under Chapter 6 of the Consumer Purchases Act—withhold payment, choose between repair and replacement, demand a price reduction, terminate the purchase, and/or claim damages. Complaints should be made in writing.
Repair or replacement
You may choose repair or replacement. The seller may refuse if impossible or entails unreasonable cost. The remedy shall be provided within a reasonable time. As a rule, the seller has no right to more than two attempts to remedy the same defect.
Price reduction
If the item is not repaired or replaced, you may demand a suitable price reduction—typically reflecting the difference in value between the defective and contractual condition. In special circumstances, the reduction may equal the significance of the defect to you.
Termination
If the item is neither repaired nor replaced, you may terminate if the defect is not insignificant.
11. Seller’s Rights in Case of Buyer’s Breach
If the buyer does not pay or otherwise breaches the agreement or the law, and the cause is not attributable to the seller, the seller may—under Chapter 9 of the Consumer Purchases Act—withhold the goods, demand performance, terminate the contract, and/or claim damages. The seller may also claim late-payment interest, collection fees, and a reasonable fee for uncollected parcels.
Performance
The seller may uphold the purchase and demand payment. If the goods are not delivered, the seller loses this right if they wait unreasonably long to pursue the claim.
Termination
The seller may terminate for material breach (e.g., significant non-payment). The seller cannot terminate if the full price has been paid. If a reasonable additional deadline is set and payment is still not made, the seller may terminate.
Late-payment interest / Collection fees
If payment is late, the seller may charge interest under the Norwegian Late Payment Interest Act. After prior notice, the claim may be sent to collection, and the buyer may be liable for fees under the Norwegian Debt Collection Act.
Fee for uncollected, non-prepaid goods
If a parcel is not collected and returns to us, a 250 NOK fee will be charged to cover shipping and administration. The fee is deducted from the refund.
12. Warranty
Any warranty from the seller or manufacturer grants rights in addition to your statutory rights. A warranty does not limit your right to complain or claim remedies for delay or defects under sections 9 and 10.
13. Personal Data
The seller is the controller for personal data collected. Unless you consent otherwise, the seller may only collect and store the personal data necessary to fulfill obligations under the agreement, in accordance with data protection law. Personal data will only be disclosed to others when necessary to fulfill the agreement with the buyer or where required by law.

14. Dispute Resolution
Complaints should be directed to the seller within a reasonable time (see sections 9 and 10). The parties will try to resolve disputes amicably. If not resolved, the buyer may contact Forbrukertilsynet (Norwegian Consumer Authority) for mediation: phone 23 400 600 or forbrukertilsynet.no.
